SMS TERMS AND CONDITIONS

Program and Consent
These SMS Terms and Conditions (the “Terms”) govern text messages sent by Mockler Leiner Law, P.A. (the “Firm,” “we,” “us,” or “our”) to clients, prospective clients, and others who agree to receive them.
By opting in to receive text messages from a web form or by another method, you agree to receive text messages from Mockler Leiner Law, P.A. and agree to these Terms. You may opt in by checking the text messaging consent box on a form on our website, by giving us your consent in writing or verbally, or by sending a text message to us first. If you text us first, we will reply to your message.
Consent to receive text messages is not a condition of retaining the Firm or receiving any service from us.
Types of Messages
The Firm sends conversational and informational text messages, including:
• replies to your inquiries and two-way conversations with Firm attorneys and staff;
• consultation and appointment reminders and other scheduling communications;
• requests for documents or information;
• updates about your matter, including hearing dates and deadlines; and
• billing and payment notifications.
We do not send marketing or promotional text messages. We do not use text messaging to solicit prospective clients.
Frequency, Rates, Opting Out, and Help
Frequency. Messaging frequency may vary.
Rates. Message and data rates may apply.
Opting out. To opt out at any time, text STOP. Reply STOP to any message from us to stop receiving text messages from that number. We also honor UNSUBSCRIBE, QUIT, CANCEL, END, REVOKE, and OPT OUT. You will receive one message confirming your request. If you communicate with more than one Firm telephone number and want to stop text messages from all of them, reply STOP to each number or tell us by telephone or email, and we will honor your request. To resume text messages, reply START.

Carriers, Security, and Attorney-Client Relationship
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Security of text messages. Text messages are not a secure form of communication. Please do not text us confidential details about your matter, account numbers, or other sensitive information. If another person, such as a spouse or family member, can access your telephone, telephone account, or cloud backups, that person may be able to read our messages.
No attorney-client relationship. Texting the Firm does not create an attorney-client relationship. An attorney-client relationship is formed only when the Firm agrees to represent you, which is ordinarily confirmed in a written engagement agreement. Do not rely on a text message to us to preserve a deadline in your matter. Opting out of text messages does not end an existing representation; we will continue to communicate with clients by other means.
Privacy, Changes, and Contact Information
Privacy. SMS consent is not shared with third parties or affiliates. No mobile opt-in data or text message consent will be shared with third parties or affiliates, and no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
